2. Site presentation

The site aims to provide useful, up-to-date information on the services provided by the publisher.

3. Access to the site

Access to the site is possible via https://vetpoint.pt/

The publisher and the IT provider have implemented technical solutions at their disposal to allow access to the Site 24 hours a day, 7 days a week;
however, at any time it may suspend, limit or interrupt access to the site or certain pages, without prior notice to users, in order to carry out maintenance work, updates, content modifications or any other action deemed necessary for the proper functioning of the Site.

The user undertakes not to interfere with, interrupt or impede the normal use of the site, including software, viruses, logic bombs, mass mailings, etc …

4. Responsibilities of the Publisher

The Publisher does not guarantee that the Site will operate without interruptions, slowdowns or errors.
The Site may experience occasional faults and some programming errors caused by updates or events beyond the Publisher’s control.

The Publisher’s liability cannot be jeopardised in the event that access to the Site or use of its services is impossible.

The site does not guarantee the accuracy, completeness or up-to-dateness of the information provided, especially in the description of the institutions, nor the absence of typographical errors.

Changes, suspensions, interruptions or degradation of the Site may occur due to a misreading by the user’s computer, the Internet and the Site, a faulty configuration or hardware or incorrect use of browsers not compatible with the Site.

No technical assistance is provided to the user electronically or by telephone, except for personal data.

The user recognises that the publisher has the right to limit or remove their access rights to the site if the publisher believes that the user has not respected the Terms or has removed or altered any content created by them. Such measures may be taken at any time and without prior notice.

5. Responsibilities of the IT Provider

The IT service provider endeavours to maintain the availability, security and quality of the Site, guaranteeing the publisher and its users the best possible access conditions.

The responsibility of the IT service provider cannot be jeopardised in the event that it is impossible to access the site or use its services.

There is no provision for technical assistance to the user, either electronically or by telephone, on the part of the IT service provider.

7. Personal Data

Whilst respecting the privacy of users of the site, Publisher, who is responsible for data processing, undertakes to ensure that the collection and processing of this information is carried out in accordance with the GDPR. Any user has, at any time and for any reason, the right to access, modify, rectify and delete any personal data they have transmitted when using the Site. To exercise their rights, users can request the deletion of their data from the Publisher at the e-mail address indicated in the Contact chapter.

Purpose of collecting and processing personal data

Personal data is collected by means of forms or cookies from third-party services. The information provided by the user is intended for the operation of the Site and … and in particular for carrying out the following operations:

– Newsletter subscription: data stored via the MailChimp service, see Newsletter section
– User analysis, anonymised data collected, see Third-party services section

Terms of personal data collection

Personal data is collected using forms or cookies from third-party services.

Third-party services

In order to guarantee a quality service, and to understand and analyse user expectations, the IT Service Provider has set up third-party tools that use cookies.

The site does not function or degrades without cookies.

Third-party services collect anonymised data. Check out this list of possible data:
– Internet protocol address (IP address)
– browser type
– access times
– operating system
– clicks and mouse movements, screen scrolling.

Here is the list of third-party services configured on the site:
– Google Analytics: quantifies and qualifies site users
– Google Maps: displays an interactive map
– Hotjar: allows you to analyse user navigation on the site

Forms

The forms on the Site allow you to send an email to the Publisher containing the fields filled in on the form. The information is not stored on the site or in a database.
Only competent members of the Publisher or the IT Service Provider will have access to this information and will treat it with the utmost respect.

Newsletter

The Publisher offers you fields to fill in your email address to receive news. Emails are managed by the MailChimp service.
MailChimp does not have access to the site and does not deposit cookies.
Only competent members of the Publisher or the IT Service Provider have access to the Mailchimp email lists managed by the Publisher.

Security of access to personal data

The Publisher and the IT Service Provider implement the necessary precautions to protect access to their servers where users’ personal data is stored. A connection via certificate (HTTPS) is set up.

The site is regularly updated by the IT Service Provider to fill any security gaps.
However, this is only an obligation of means, no Internet service can currently offer its users absolute guarantees in this area. The Publisher or the IT Service Provider cannot be held responsible for the protection of data flowing from the user’s computer station to the Site.
The Publisher and the IT Service Provider use highly secure passwords to access the servers, data, databases and e-mail lists collected. Only trained and competent employees of the Publisher or the IT Service Provider have possession of these accesses.

Deletion of personal data

To delete the data collected, please contact the Publisher using the means provided in the Contact chapter.

8. Consent

Browsing the site implies acceptance of the Terms. In accordance with the GDPR, acceptance of the use of cookies lasts for 13 months.

9. Hypertext links

The Publisher cannot be held responsible for the practices exercised by the general conditions of use of other Internet sites to which the user will have access via links present on the Site, or integrated into an encapsulation device.
The user is strongly advised to check the general conditions of use of all sites visited and to contact their operator, host or owner directly in the event of difficulties.

Likewise, in the event of access to the site via a link on another site, the publisher is not bound by the general terms and conditions of use of said third-party site.

10. Intellectual property

The structure of the Site, as well as the texts, graphics, images, photographs, sounds, videos and computer applications that make it up, are the exclusive property of the Publisher and are protected as such under current intellectual property laws.

Any representation, reproduction, adaptation or partial or total use of the contents, brands and services offered by the Site, by any means, without the express prior written permission of the Publisher, is strictly prohibited and is likely to constitute an offence within the meaning of articles L. 335-2 et seq. of the Intellectual Property Code.
Access to the Site does not constitute recognition of a right and, in general, does not confer any intellectual property rights relating to any element of the Site, which remain the exclusive property of the Publisher.

11. Changes to the general conditions of use

The Publisher may modify these Terms of Use at any time.
Modifications will take effect as soon as they are published on the Site for a user who has not transmitted personal data.

12. Applicable Law

These general conditions are governed by current Portuguese and European law.
Any dispute between the Publisher and the user shall fall within the jurisdiction of the competent court whose jurisdiction is governed by the location of the Publisher’s registered office.
